1. About These Terms

These Terms and Conditions govern your use of the website at customoutdoorkitchensydney.com.au and any services provided by MJ Leckie Carpentry Pty Ltd (ABN to be confirmed), trading as MJ Leckie Carpentry, NSW Contractor Licence No. 353438C ("we", "us", "our").

By accessing our website or engaging our services, you agree to these terms. If you do not agree, please do not use our website or services.

2. Our Services

We design and construct custom outdoor kitchens and alfresco cabinetry for residential properties in Sydney, with a focus on the Northern Beaches region. Services include design consultations, material selection, fabrication, and installation.

3. Quotes & Pricing

• All quotes are provided in Australian Dollars (AUD) and are valid for 30 days from the date of issue unless otherwise stated.
• Quotes are estimates based on information provided at the time. Final pricing may vary if the scope of work changes.
• GST is included in all quoted prices unless explicitly stated otherwise.
• We reserve the right to adjust pricing if material costs change significantly between quote and commencement of work, with your prior agreement.

4. Deposits & Payments

• A deposit (typically 50%) is required to confirm your booking and commence work.
• The balance is due upon practical completion of the installation, unless otherwise agreed in writing.
• Payment may be made by bank transfer or card via our secure payment processor (Stripe).
• Overdue payments may attract interest at 10% per annum.

5. Cancellations & Variations

• Cancellation after deposit payment may result in forfeiture of the deposit to cover costs already incurred (materials ordered, design work completed).
• Any variations to the agreed scope of work must be agreed in writing and may affect pricing and timelines.

6. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). You are entitled to a repair, replacement, or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms limits or excludes any rights or guarantees you have under the ACL.

7. Workmanship Warranty

We warrant our workmanship for a period of 12 months from the date of practical completion. This warranty covers defects arising from faulty workmanship but does not cover:

• Normal wear and tear
• Damage caused by misuse, neglect, or failure to maintain
• Damage caused by third parties or events outside our control
• Manufacturer defects in materials (which may be covered by the manufacturer's own warranty)

8. Council Approvals & Permits

It is the responsibility of the client to obtain any required council development approvals or permits before work commences, unless expressly agreed otherwise in writing. We can advise on typical requirements but cannot guarantee approval outcomes. Work will not commence until required approvals are in place.

9. Limitation of Liability

To the maximum extent permitted by law, our liability to you is limited to the total amount paid by you for the relevant service. We are not liable for any indirect, consequential, or special loss or damage. This limitation does not apply to liability that cannot be excluded under the ACL.

10. Website Use

• The online kitchen planner tool is provided for illustrative purposes only. Designs created in the planner are indicative and subject to professional review before any quote is finalised.
• We make reasonable efforts to keep the website accurate and up to date but do not warrant that information is always current or error-free.
• You must not use our website for any unlawful purpose or in a way that could damage, disable, or impair it.

11. Intellectual Property

All content on this website (including text, images, designs, and the planner tool) is owned by or licensed to MJ Leckie Carpentry. You may not reproduce, distribute, or create derivative works without our written permission.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
